Novo Patent on Victoza to Be Reviewed After Mylan Challenge

Mylan has established a “reasonable likelihood” of winning its argument that Novo Nordisk’s patent 8,114,833 for the blockbuster diabetes drug Victoza is invalid, according to the Patent Trial and Appeal Board, which said it has instituted a review of the patent.

  • Mylan contends the patent, for formulations to reduce crystallization that clogs needles, doesn’t cover anything new
    • Novo Nordisk said scientists didn’t initially realize that a widely used stabilizing agent called mannitol was clogging the injectors, and that a change to propylene glycol would solve that problem
