The overturning of a $25 million verdict in an Accutane inflammatory bowel disease case will be reviewed by the New Jersey Supreme Court (McCarrell v. Hoffmann LaRoche, Inc., N.J., A-28-15, review granted 11/20/15).
Andrew McCarrell, an Alabama resident, argued that drugmaker Hoffmann-LaRoche Inc. failed to adequately warn that its withdrawn acne medication could cause inflammatory bowel disease.
A jury in the New Jersey Superior Court for Atlantic County awarded $25.16 million in compensatory damages to McCarrell in 2010 in the second trial of his suit 8 PLIR 238, 2/26/10.
