Merck KGaA Bid to Halt Unauthorized IVF Treatments to Be Probed

The U.S. International Trade Commission said it has begun an investigation into a complaint filed by Merck KGaA’s EMD Serono over unauthorized in vitro fertilization treatments.

  • EMD Serono claims the treatments packaged in Turkey for foreign markets are improperly entering the U.S. and it seeks to stop “unauthorized and potentially dangerous sale”
  • EMD Serono filed the complaint in March, claiming the so-called gray market Gonal-f and Ovidrel products are different than IVF products the company developed for the U.S. market
