McKesson Can’t Boot Counties’ Opioid Suit From State Court

Drug distributor McKesson Corp. failed in its bid to keep in federal court a suit against it and other opioid distributors and manufacturers over allegedly deceptive opioid marketing.

The suit by Utah counties and a county health department over the opioid crisis didn’t involve a substantial question of federal law that warranted a federal court hearing the case, Judge Robert J. Shelby of the U.S. District Court for the District of Utah said. Shelby sent the suit back to state court in Uintah County after concluding the federal court didn’t have the authority to hear the case.
