Mallinckrodt, Takeda Settle With Zydus on Amitiza Patent Case

Mallinckrodt’s Sucampo unit and Takeda had claimed that Zydus Cadila’s proposed generic version of Amitiza, used to treat opioid-induced constipation, infringes five patents owned by Sucampo and licensed to Takeda.

  • Zydus conceded infringement and agreed to be blocked from selling copycats until Jan. 1, 2023, “or at such earlier date as may be permitted by the resolution to which the parties have agreed,” according to consent judgment approved Friday in federal court in Trenton, New Jersey
