Labrador Diagnostics LLC is extending royalty-free licenses to other companies seeking to use its diagnostics technology for developing new coronavirus tests.
However, the company isn’t dropping a patent infringement lawsuit filed March 9 in the District of Delaware against bioMerieux S.A., a company that announced on March 11 plans to launch three tests to address the Covid-19 epidemic.
One will be ready by the end of March, with the other two due in the second and third quarters of 2020.
Labrador argues that the patents it had inherited from the defunct Theranos are being infringed by bioMerieux.
