Urine test cup maker Rembrandt Diagnostics LP’s claim alleging Innovacon’s sales of competing test cups infringe one of Rembrandt’s patents is alive again.
The court’s earlier dismissal of the infringement claims was based on a faulty understanding of a patent licensing agreement between Rembrandt and Innovacon’s predecessor company, Judge Cathy Ann Bencivengo of the U.S. District Court for the Southern District of California said.
The ruling means Rembrandt may be able to recover patent infringement damages from Innovacon if it prevails in the suit. Rembrandt must file a third amended complaint alleging sales of a urine test cup called iCup ...
