A False Claims Act whistleblower adequately alleged that Radiation Therapy Services PSC and other Kentucky cancer treatment providers violated the False Claims Act by falsely telling federal healthcare programs that radiation services were performed by qualified personnel, a Kentucky federal court said.
Robert O’Laughlin, a radiation oncologist, sufficiently alleged that defendants improperly billed the government for services provided by technical staff instead of qualified physicians, Judge David L. Bunning of the U.S. District Court for the Eastern District of Kentucky said Tuesday.
