J&J’s Abiomed Defeats Getinge Unit at Heart-Pump Patent Trial

A Massachusetts federal jury invalidated the only patent claim Maquet Cardiovascular LLC asserted in a trial over heart-pump technology, also finding Abiomed Inc.'s Impella devices wouldn’t have infringed because they operate differently from the patented invention.

Jurors in the US District Court for the District of Massachusetts found claim 1 of US Patent No. 10,238,783 invalid for lack of both written description and enablement, according to a verdict form docketed Friday.

They also concluded that the Johnson & Johnson affiliate’s accused products—the Impella 2.5, 5.0, CP, and CP with Smart Assist—don’t infringe under the reverse doctrine of equivalents.
