Staffing company RCM Technologies USA Inc. and health-care workers allegedly shorted on overtime pay secured final approval of a $1.5 million class settlement from a federal court in California.
Rhonda Hubbard alleged RCM underpaid employees on travel assignments in California by excluding the value of weekly per diem and stipend payments from the “regular rate” when calculating overtime pay.
She sued in the U.S. District Court for the Northern District of California, raising claims under the California labor code and unfair business practices laws. The court certified a class in October 2020.
