Glaxo Wins Rejection of Expert in Paxil Case

“Speculative” expert testimony about a boy’s future lost wages and medical expenses won’t be allowed in a lawsuit alleging that in utero exposure to the antidepressant Paxil caused birth defects (Gibson v. Smithkline Beecham Corp., 2016 BL 82859, S.D. Miss., 1:14-cv-00319-LG-RHW, 3/17/16).

Dr. Aaron M. Wolfson, the proposed vocational rehabilitation expert, failed to support his opinion that the 11-year-old boy’s formal education would likely terminate after high school graduation, Judge Louis Guirola said March 17 for the U.S. District Court for the Southern District of Mississippi.
