Gilead Whistleblower Must Give iPhone, MacBook to Investigator

A whistleblower accusing Gilead Sciences Inc. of violating the False Claims Act must provide his iPhone, iCloud, and MacBook to an investigator to determine if text messages or other communications not previously produced are permanently lost, a Pennsylvania federal court said.

A sanction, such as dismissal of the drug kickback suit, could become appropriate if the whistleblower is found to be responsible for lost information, Judge Mark A. Kearney of the U.S. District Court for the Eastern District of Pennsylvania said Wednesday.
