A Georgia hospital will face a suit alleging it retaliated against a doctor for reporting possible violations of a federal law that prohibits transferring uninsured patients without first screening or stabilizing them, a federal court in the state said.
Rick Nulph sufficiently alleged that Houston Healthcare System Inc. removed him as emergency department director at Perry Hospital for complaining about its “city call” policy in violation of the Emergency Medical Treatment and Labor Act’s whistleblower protection provision, the U.S. District Court for the Middle District of Georgia said.
The court denied the hospital’s motion to dismiss.
