Florida Sues Over HHS Rule Blocking Kids Insurance Disenrollment

Florida is suing to prevent the Biden administration from enforcing a rule requiring children covered under a federal-state health insurance program to stay enrolled even if their parents fail to pay premiums.

On Tuesday, Florida’s Medicaid program filed suit in the US District Court for the Middle District of Florida alleging that the US Department of Health and Human Services overstepped its authority under the Administrative Procedure Act when it advanced a final rule banning states from disenrolling kids from the Children’s Health Insurance Program, a cooperative effort run by the states with federal supplemental funding through Medicaid.
