President Joe Biden likely didn’t have authority to order all federal workers and contractors to be vaccinated against Covid-19 or risk losing their jobs, the full Fifth Circuit said.
The en banc court’s decision Thursday reinstated a nationwide preliminary injunction prohibiting the administration from enforcing its vaccine mandate. Thirteen of the court’s 17 judges agreed that the employees could proceed with the suit challenging the mandate’s constitutionality.
A federal district court may now get a chance to decide the case on the merits, or the government could ask the US Supreme Court to weigh in.
