Ex-Blue Cross Worker Who Uses CBD for Migraines Gets Bias Trial

Blue Cross & Blue Shield of Florida Inc. may have violated federal and Louisiana disability discrimination laws when it fired a long-time employee who uses CBD oil for her severe migraines after she failed a drug test, a New Orleans federal judge ruled.

A jury could find BCBS failed to accommodate Michelle Huber’s hemiplegic migraines, which “cause one-sided weakness and total impairment,” typically for three days per occurrence, the US District Court for the Eastern District of Louisiana said.
