A Catholic medical group is seeking to invalidate the Biden administration’s interpretation of a federal emergency care law that allegedly requires doctors to perform abortions in certain situations.
The Catholic Medical Association sued the US Department of Health and Human Services and Secretary Xavier Becerra Jan. 10 in the US District Court for the Middle District of Tennessee. It challenged a July 2022 HHS memo and letter saying the Emergency Medical Treatment and Labor Act requires doctors to perform abortions when necessary to treat an emergency medical condition, even in states where the procedure is illegal.
