California Internet Youth Safety Law Faces First Court Challenge

Opponents of a first-in-the-nation law that requires websites to regulate the type and quantity of content available to kids and teens, as well as the collection of their browsing data, will ask a federal judge on Thursday to block its enforcement as unconstitutional.

The tech trade group NetChoice argues the federal Children’s Online Privacy Protection Act and Section 230 of the Communications Decency Act preempt the California legislation (AB 2273) which was passed last year. The organization’s members include Google, Facebook and Instagram parent Meta Platforms Inc., and TikTok parent, ByteDance Ltd.
