Boston Scientific Patent Case Moved Based on High Court Ruling

Boston Scientific Corp. must bring its patent infringement lawsuit against Cook Group Inc. in Indiana over surgical clips used to prevent bleeding, a federal judge ruled.

The U.S. District Court for the District of Delaware granted Cook’s request to transfer venue Sept. 11 because Cook had no physical facilities, corporate offices or employees in the district. Although Cook employees would meet with physicians and sell products in the state, that’s not enough to meet the regular and established place of business requirement for suing there, the court said (Bos.
