Biogen Idec sued Neurobiogen LLC in federal district court Feb. 17 for trademark infringement and unfair competition, arguing that the defendant’s name is “confusingly similar” to Biogen (Biogen Idec MA, Inc. v. Tranfiled).
Biogen, which is based in Cambridge, Mass., wrote in its complaint in the U.S. District Court for the Northern District of California that it has been using “Biogen” as a mark and name for more than 30 years, while Neurobiogen didn’t register to do business in California before Jan. 9, 2012, and didn’t secure the domain name http://www.neurobiogen.com before Dec. 24, 2011.
