Bayer, Teva Settle Patent Litigation, Ending Fight Over Levitra Generic

Bayer AG and Teva Pharmaceuticals USA Inc. Nov. 21 ended their patent fight over whether Teva’s application to sell a generic copy of Bayer’s erectile dysfunction drug Levitra (vardenafil hydrochloride tablets) infringed two patents on the drug (Bayer Schering Pharma AG v. Teva Pharmaceuticals USA Inc.).

Chief Judge Gregory M. Sleet of the U.S. District Court for the District of Delaware entered a consent judgment ending the patent battle initiated in 2009 (7 PLIR 798, 7/10/09) after the parties reached a settlement in the litigation.
