Bayer won a victory in California Essure litigation as the court overseeing some 13,000 plaintiffs’ cases left them with one viable claim over the permanent contraceptive.
Plaintiffs may pursue claims based on Bayer’s alleged failure to report serious medical events to the Food and Drug Administration, following two rulings by Judge Winifred Smith of the California Superior Court, Alameda County.
Bayer called that claim “factually meritless and unsubstantiated” and said it “looks forward to defending its position in court and vindicating its product.”
Plaintiffs’ attorneys weren’t immediately available for comment.
