Aetna Beats Provider’s Would-be Class Suit Over Covid-19 Tests

Aetna Health of California Inc. defeated a proposed class action by a medical provider that accused the insurer of underpaying for Covid-19 testing costs, but the provider will have another chance to bring claims under federal benefits and racketeering laws.

Saloojas Inc.'s claims under the federal Covid relief statutes—the Coronavirus Aid, Relief, and Economic Security Act and the Families First Coronavirus Response Act—fail as a matter of law, because these statutes don’t establish a private right to sue, Judge Jacqueline Scott Corley of the US District Court for the Northern District of California said Sept. 30.
