Ripple Analytics Can’t Enforce CEO’s Trademark, 2nd Cir. Says

Human-resources software company Ripple Analytics Inc. can’t press its trademark infringement suit because its CEO, not the company, owns the “Ripple” trademark.

Cofounder and CEO Noah Pusey backed the suit but never formally joined as a plaintiff or accepted to be bound by its outcome despite several invitations to do so, the US Court of Appeals for the Second Circuit said Tuesday. That doomed trademark and unfair competition claims against HR platform People Center Inc.—which operates as Rippling—the three-judge panel said in the precedential decision.
