A global ride-sharing company and two local affiliates lost their bid to block enforcement of New York City’s rules requiring them to report time, driver, and location data for trips they provide.
The 2017 rules challenged by Wheely USA Inc., Mayfair-NY LLC, and Kensington-NY LLC didn’t effectuate an administrative search in violation of the Fourth Amendment, the US District Court for the Southern District of New York said April 10. Nor did the disclosure rules compel speech in violation of the First Amendment, Judge Colleen McMahon said.
