Judges Skeptical of NFL Push to Arbitrate Coach’s Bias Claims

A Second Circuit judge seemed hesitant to require arbitration of former Miami Dolphins head coach Brian Flores’ race discrimination claims with the National Football League.

Such a requirement could set a precedent that lets employers put the head of the company in charge of arbitrating employee claims, US Court of Appeals for the Second Circuit Judge Gerard Lynch said during oral arguments Tuesday. “They will do it if we set a precedent that lets them because it’s hard to say sports leagues are entirely unique on this issue,” he added.
