Allergan Appears to Settle $75 Million Suit Over Oculeve Buyout

An affiliate of AbbVie Inc. subsidiary Allergan Plc has reached an apparent settlement of claims in Delaware that it it wrongly withheld $75 million from former Oculeve Inc. shareholders after buying the company and getting its implantable tear stimulator approved by regulators.

The two sides docketed a joint stipulation Tuesday dismissing the case from Delaware Chancery Court, nearly two years after Vice Chancellor Morgan T. Zurn let the lawsuit move forward with claims that Allergan found a pretext for refusing to turn over the second post-deal “milestone” payment.

Zurn granted the joint dismissal motion without comment later Tuesday.
