Zimmer Biomet Owes Device Sale Commissions, Appeals Court Says

Medical device manufacturer Zimmer Biomet Holdings must provide device distributors with years of unpaid commissions on sports medicine and trauma products, the Seventh Circuit ruled.

A jury reasonably found the company breached its contract with six distributors after agreeing to pay them lifetime commissions on devices that fell within each distributor’s “subject distributorship,” Judge Michael Y. Scudder, of the US Court of Appeals for the Seventh Circuit, wrote, quoting the contract language.
