Zeus Networks Loses Bid to Arbitrate Video Privacy Lawsuit

Zeus Networks LLC lost its bid to send a consumer’s claims that it illegally shared his video-watching history with Meta Platforms Inc. to an arbitrator, after a federal appeals court ruling.

The arbitration agreement in the Zeus Networks online terms of service wasn’t conspicuous enough to put a reasonably prudent person on inquiry notice that buying a subscription would bind the subscriber to arbitration, the US Court of Appeals for the Eleventh Circuit said May 1. It affirmed a lower court’s denial of Zeus’s motion to compel arbitration.
