Yippee Entertainment Loses Bid to Arbitrate Privacy Class Action

A proposed class action alleging that Yippee Entertainment Inc. shared the video-watching histories of its subscribers with third parties in violation of the Video Privacy Protection Act will be heard in federal court rather than before an arbitrator.

Plaintiff Brittany Morrison wasn’t bound by a mandatory-arbitration clause in the Yippee terms of service because the company’s website didn’t sufficiently put her on notice of the agreement, Judge Michael M. Anello of the US District Court for the Southern District of California said Thursday.
