Yellow Corp. isn’t entitled to relief from a judgment dismissing its breach of contract suit against the International Brotherhood of Teamsters and several other local unions, because it didn’t exhaust its administrative remedies under the applicable collective bargaining agreement, a federal court said.
Yellow and its affiliates, which are in the midst of bankruptcy proceedings, said that the unions’ failure to resolve employee seniority issues was impeding its restructuring, but the court dismissed the suit in March. Yellow filed its motion for relief from the judgment under Federal Rules of Civil Procedure 59(e) and 60(b).
