Yamaha Defeats WaveRunner Purchasers’ Product Design Lawsuit

Yamaha defeated a lawsuit from two men who alleged design fraud and a breach of contract concerning a model of its WaveRunner personal watercraft.

Chicago Judge Matthew F. Kennelly granted Yamaha Motor Corp. USA and Nielsen Enterprises Inc.'s motion to dismiss on Tuesday, ruling the suing purchasers failed to state viable claims for relief. The purchasers, Mitchell Higgins and Tim McHenry, will have a chance to amend their complaint to bring viable claims for fraud and breaches of written and implied warranties, the judge wrote in a memorandum opinion and order.
