X’s Preemption Claim on Minnesota Political Deepfakes Law Fails

X Corp. lost an early round in its lawsuit challenging a Minnesota state law that criminalizes the dissemination of election-related deepfakes online.

Judge Laura M. Provinzino of the US District Court for the District of Minnesota rejected X’s argument that Section 230 of the federal Communications Decency Act, which provides broad legal immunity for third-party content to internet platforms, preempts Minnesota’s law.

Provinzino found that X failed to provide evidence that it face an enforcement action and therefore lacks legal standing for its Section 230 claim.
