Midwest Athletics and Sports Alliance LLC will pay
Midwest’s “objectively unreasonable and improper litigation tactics” at the summary judgment stage warrant the organization to pay Xerox’s attorneys’ fees tied to Midwest’s wrongdoing, Judge Elizabeth A. Wolford of the US District Court for the Western District of New York wrote in an opinion filed Friday. Wolford also said awarding attorneys’ fees is sufficient to address Midwest’s misconduct and denied Xerox’s request for expert fees.
