A Wyoming gun rights advocacy group convinced the Tenth Circuit that a state statute requiring donor disclosures for “electioneering communication” was unconstitutional under the First Amendment as applied to the group.
Though Wyoming’s secretary of state showed the disclosure requirements were substantially related to anticorruption and informational interests, the disclosure regime wasn’t narrowly tailored as-applied to Wyoming Gun Owners, Judge Timothy M. Tymkovich said for the US Court of Appeals for the Tenth Circuit on Wednesday.
