Wynn Cocktail Server’s Issues Wearing Heels Fuel Job Bias Trial

Wynn Las Vegas LLC may have interfered with a cocktail server’s right to take medical leave for a chronic ankle condition and fired her in violation of disability discrimination laws, a Nevada federal judge ruled.

According to the company, Tiare Ramirez was suspended and then terminated because she misused her intermittent leave under the Family and Medical Leave Act. Ramirez wore high heels to a social event, prompting her to call off work, even though her doctor’s note said she wasn’t supposed to wear heels, which typically are part of a cocktail server’s uniform, the company said.
