Wyndham Can’t Duck Suit Over Alleged Timeshare Deception

Wyndham Vacation Resorts Inc. can’t shed a suit by an elderly, non-native English speaking couple who allege it tricked them about the value and redeemability of two timeshare agreements, a Nevada federal court said.

Wyndham’s arguments that the plaintiffs’ claims were time-barred rely on “unreasonable inferences” about when and what the plaintiffs should have known about the alleged deception, the U.S. District Court for the District of Nevada said Wednesday.

Juan Chavez, who doesn’t speak English, and Socorro Chavez, who speaks English as a second language, bought timeshares from Wyndham in 2013 and 2015, totaling $41,834.
