Would-Be Gun Dealer Revives Challenge to New York License Rules

A prospective commercial gun dealer has standing to contest a New York City mandate regarding a physical location for sales, a federal appeals court ruled Tuesday.

The credible threat of criminal prosecution Cavalier D. Knight faces for unlicensed gun dealing can constitute an injury-in-fact for standing purposes, the US Court of Appeals for the Second Circuit said in a per curiam opinion. The appeals court partially reversed a district court’s dismissal of the lawsuit and remanded it.
