Amica Mutual Insurance Co. must face an employee’s claim that she was constructively discharged because of her job-protected medical leave even though she gave 30 days notice she’d be leaving, a federal court ruled.
The former customer care representative also didn’t undercut her forced-to-quit claim by offering to cooperate in any investigations into her attendance and pending Family and Medical Leave Act request while she remained with the company for another month, the US District Court for the District of New Hampshire said Tuesday.
