Workday Defeats Job Bias Suit Over AI Screening Tools, for Now

A Black man over age 40 who has mental health issues must try again with his allegations that Workday Inc.'s algorithm-based screening tools have kept other companies from hiring him and other job seekers based on race, age, and disability.

The September proposed class action failed to adequately plead a basis for holding the software vendor liable for the alleged bias, the US District Court for the Northern District of California said. The allegation seeking to hold Workday liable as an “employment agency” didn’t include sufficient detail under federal pleading rules, the court said.
