Wonderful Loses Court Review of Union Certifications on Appeal

A California employer cannot challenge a union certification decision outside of established labor law procedures, a state court of appeal ruled, overturning a lower court’s decision.

The appellate court ruled a Kern County, California superior court lacked jurisdiction to hear Wonderful Nurseries LLC’s challenge to the state Agricultural Labor Relations Board’s certification of United Farm Workers of America as the bargaining representative for its employees, Justice Rosendo Peña Jr. said in an opinion. The California Court of Appeal for the Fifth Appellate District reversed the lower court’s ruling Tuesday.
