A proposed consumer class action alleging Wolf Appliance Inc. and Sub-Zero Group Inc. have refused to redesign their gas stoves to reduce emissions and failed to warn customers of the products’ health risks can proceed, a federal judge said.
The appliance makers didn’t show the Energy Policy and Conservation Act preempted the consumers’ claims, the US District Court for the Western District of Wisconsin said Tuesday. The law preempts a number of state regulations concerning energy use.
