Wise ‘Cheddar & Sour Cream Flavored’ Chip Label Not Deceptive

Wise Foods Inc.'s “Cheddar & Sour Cream Flavored” potato chips packaging wouldn’t mislead a reasonable consumer into thinking the snack had no artificial flavors, a New York federal court said on Monday, focusing on the word “flavored.”

Bronx resident Darlene Wallace raised proposed class claims against Wise for failing to disclose the presence of artificial diacetyl, a compound that mimics the buttery aroma of sour cream.

But the Wise chips are labeled as “Cheddar & Sour Cream Flavored,” Judge J. Paul Oetken of the U.S. District Court for the Southern District of New York said.
