A proposed class action against supermarket chain Winn-Dixie Stores Inc. over pricing practices for its buy one get one free promotion was tossed by a federal judge in Florida.
The three Winn-Dixie shoppers who brought the suit failed to sufficiently allege they suffered damages or that the products they purchased as part of the BOGO deal were worth less than what they paid, Senior Judge Harvey E. Schlesinger of the US District Court for the Middle District of Florida said in a Thursday order dismissing the suit without prejudice.
