WinCo Foods Settles DaVita’s Health Plan Dialysis Coverage Suit

WinCo Foods LLC reached a confidential settlement with dialysis provider DaVita Inc., resolving a federal lawsuit accusing the Idaho-based supermarket chain of changing how its health plan covers kidney disease treatment in violation of federal health and benefits law.

The settlement requires WinCo to maintain network coverage for dialysis treatment in its employee health plan and to refrain from conditioning dialysis coverage on a plan participant’s eligibility for Medicare. Winco also agreed to make an unspecified monetary payment to DaVita, according to a joint stipulation filed Monday in the US District Court for the District of Idaho.
