Why Class Action Incentive Awards May Be in Jeopardy: Explained

The US Supreme Court is about to get the chance to weigh in on a deepening circuit split over incentive payments to class representatives.

In the nearly three months since the Eleventh Circuit declined to reconsider its decision prohibiting such payments, the Second and Ninth Circuits have squarely rejected its holding.

That divide should bolster a soon-to-be-filed bid for high court review of the Eleventh Circuit’s decision in Johnson v. NPAS Solutions, LLC, which Ashley Keller of Keller Postman LLC confirmed is on the way.
