Whole Foods Spring Water Arsenic Lawsuit Voluntarily Dropped

A Whole Foods customer who alleged in a would-be class suit that the chain deceptively marketed Starkey Spring Water as “pure” despite a high arsenic content has voluntarily dropped his claims, according to filings in a California federal court.

David Berke alleged independent testing by Consumer Reports and the Center for Environmental Health showed Whole Foods’ Starkey Water brand contained some of the highest levels of arsenic among bottled waters.

He sued Whole Foods Market California Inc. and affiliated companies, seeking to represent California and multistate classes.
