Whitepages Inc. must face a proposed class action alleging it used the identities and personal information of consumers to promote its online “people search” services without consent in violation of Washington state’s right-of-publicity laws.
The plaintiffs had standing to bring their lawsuit in federal court, and adequately stated claims under the laws of Washington, California, Illinois, and Ohio, Judge John H. Chun of the US District Court for the Western District of Washington said Monday.
Chun also rejected the company’s argument that its terms of service and provisions of the state statutes barred the plaintiffs’ class claims.
