White Officer Loses Appeal in DEI Suit Over Employer’s Training

The Colorado Department of Corrections saw its win upheld Monday against a White correctional officer who said an equity, diversity, and inclusion training program created a racially hostile work environment.

The officer failed to allege how the training amounted to or spurred race-based harassment that was sufficiently severe or pervasive to violate Title VII of the 1964 Civil Rights Act, the US Court of Appeals for the Tenth Circuit ruled. He didn’t describe how his daily work environment was affected by the “racial rhetoric contained” in the training, the court said.
