Whirlpool, Home Depot Defeat Energy Star Washer Rating Appeal

Manufacturer Whirlpool Corp., retailer Home Depot USA Inc., and others are entitled to judgment in litigation challenging Energy Star ratings on certain Maytag washing machines, the Third Circuit affirmed Friday.

The appeals court upheld dismissal of purchasers’ breach of warranty and consumer protection law claims.

The Department of Energy’s Energy Star program authorizes manufacturers to affix an Energy Star label to appliances that meet certain standards of efficiency.

Certain Maytag models were approved to display that logo, which they did from April 2009 until they were discontinued in December 2010.
